A BRITISH holidaymaker is suing a car hire company after claiming to have had his deposit withheld for damage he did not cause.

Policeman David Evans, 50, from Manchester, rented a vehicle from Costa del Sol-based Brian’s Rent a Car during a week-long holiday in Fuengirola.

But despite claiming to have returned the car in the same condition, Evans says he has had his €300 deposit withheld and a further €122 taken from his card since returning to England.

“The company claimed the seat had been damaged by the arm rest being wrenched out of the seat and thrown into the footwell of the car, which is nonsense,” Evans told the Olive Press.

“It was already broken when I picked up the car.

“Then when they finally contacted me at home they were quite abusive. I can’t believe they can behave in this manner.”

Evans continued: “If this stops other people getting in the same situation then I’ll be happy.”

But Brian’s Rent a Car boss David Ballard denies the accusations, insisting the seat was not damaged when Evans took the car.

“We would not rent out a vehicle that was in a bad condition,” Ballard insisted.

“We did everything we could to contact the client straight away after the vehicle had been returned and we would never keep a deposit without proof of damage.

Evans however, is not the only client to complain.

Several others have accused the company, based in Benalmadena, of withholding money for damage they claim not to have caused.

One Gavin Johnson, from Manilva, claims his deposit was withheld despite the firm cancelling the booking at late notice.

Johnson had a deposit of €250 withheld due to a dispute over alleged damage (a scratch on the paintwork), after Ballard insisted Johnson had left it too late to complain.

The case went to arbitration through Spanish consumer watchdog OMIC, who ruled the case can only be dealt with through the courts.

Johnson is due to meet with Spanish police this week to discuss the issue.

Meanwhile, Stefan Hermes had his deposit taken and not returned despite never having taken delivery of a car.

It came after the firm cancelled the booking at the last minute.

“There are several disputes we have had with clients and they are all liars,” Ballard added. “We would never con a client in a million years.”

  1. I too, have had my deposit kept by David Ballard earlier this year. He also became abusive when I met up with him by chance at Santa Maria golf club, where I spoke to him face to face. I believe that his so called contacts that he uses are not worth the paper that they are written on. This is the typical action of what gives the Costa Del Sol bad press. I live here, and I wish people like David Ballard should go back to the place they come from.

  2. This may sound a little naive but is there no documentation relating to the state of the vehicle when hired, and another signed declaration upon return?. If not, it’s no wonder these car rental people try it on.

  3. They didn’t notice damage of that magnitude when he returned it ? ? ? They have to get in to park it, and it would have been obvious. “Your conclusion, Holmes.” “It did not happen, Watson.” They should be ‘denunciado-ed’ for attempt deception.

  4. I rented a car from goldcar for a weekend. On the internet the price was 30 euros but after fuel and additional driver, insurance it was 190 euros. I could not claim the half tank of fuel back that was charged at a high rate. This year I am going to run a car of my own in Spain and insure it there. I am always in fear of claims etc and if you pay for additional insurance it is very expensive so what is the point in being ripped off. I now hire from Europcar or Hertz if required. They may sound expensive at the start but they do not have all these con tricks such as all the others I have tried.

  5. We usually rent 3-4 times a year when visiting our place in Andalucia, usually from the cheapest on the net. Always a scam going on somewhere, if not for exhorbitant full fuel tank prices, then for damage when returned. Amparo: I’ve personal experience of rental staff refusing to check the car with me upon pick up (“If you don’t like it, give me the keys back and rent from someone else.”), and also refusing to check the car when it is returned (“Don’t worry, the insurance will cover any damage.”). We’ve also been double dipped when a rental was hit by another driver who accepted full responsibility, and the agency collected from the insurers AS WELL AS keeping our deposit! And then the internet broker accepting no responsibility for withheld funds, saying that they “will investigate” but that these things can take a while (18 months later still waiting). Having your VISA number and a contract where you accept all liability whatever the cause is simply a licence to steal, as my bills clearly show. Spanish, German, English, they’re all ‘Car Rental Crooks’.

  6. The Olive Press are doing a good job here. As they have reported I also lost my deposit from Brian’s Rent a Car. From my own investigation you can find similar stories on the Internet, for example on the Malaga Web Forum and also on the Trip Advisor site.

    As I live in Spain I returned to confront David Ballard. He sent me away to a false name and address.

    I’d like to congratulate Mr Evans for his courage and tenacity in taking this action. It’s time for David Ballard to realise that his scam is over. Rod Wigley said it best “David Ballard should go back to the place he came from”. I’ll second that!

If the adage “you get what you pay for” does not apply to the car rental sector, then it would appear there is a brilliant business opportunity here for someone with a little capital and a sense of professionalism. And then the cowboys would sit up and take notice. I find it difficult to believe no-one fits the bill at the airport.

    Whenever I visit the UK I always use Europcar and they don’t get their hands on my credit card until I have the status report and they don’t get their keys back until I have the return status report. And they have never quibbled.

  8. Since this article was published I have seen statements from the company (Briansrentacar)co-owner Claiming that David Ballard did not make Comments to James Bryce that the people who have made representations to the company to dispute their version of Events are all LIARS.
    I Understand from that statement that Briansrentacar are now claiming James Bryce is telling Lies!
    You can read those comments on Tripadvisor.
    I have still not received from Briansrentacar ANY evidence/photos/estimate to support their claims I damaged their vehicle, Even though the post on Forums they have sent that documentation.
    Its upto others to make a choice if they want to enter into buisness with this company.
    My advise would be Avoid them at all costs.

  9. Just to provide an update for anyone reading this article,
    Deposit claimed back via credit card company.credited back to our account, has taken over 3 months though.
    Never received any evidence, photos estimates etc from Briansrentacar.
    All infrormation is now being dealt with by the Spanish Police as others have come forward to complain of the same type of incidents involving Briansrentacar.
    Comments on Tripadvisor and Malagaweb show several problems with this company, However I now feel this answers those on the site as to who has been telling the truth and who has been telling porkies as one commented!
    I would still advise anyone to avoid this compant at all costs.

  10. Mr Evans is a police man and should know the contract he signed according to Briansrentacar did not show the damage.
    He and all car hire clients must check carefully the contract they sign to ensure all damage is shown.
    Here in Spain cars are damaged in parking areas and show you excess insurance is essential.
    I use Briansrentacar for years and pay excess insurance and have never had a problem with this company.

    Rod signed a 12 month contract, payment 1st day of each month. then on the second month 2 hours after he was due to pay he informed us he could not pay and wanted to return the car without any notice and in breach the contract he signed.

    He changes his story every year. Johnson dumped our car in the Gap garage in Arroyo on his way to hire another car at the airport. When the car was returned to our garage he was contacted to come inspect the damage on the car which he refused. He was sent photos of the damage and invoices which he ignored.
    A few months later he reported us to the reclamation office who after seeing the photos and invoices of cost kicked his case out and told him he would have to pay.
    Strange he now writes he is going to the police it is nearly 2 years since he damaged our car.

    If he is a police man, he is a very,very, very poor example.
    Evans signed a contract which incorporated a car plan which marked all existing damage present on the car before he drove away.
    The car seat was not marked as damaged nor did he report it damaged during his hire or on his return of the car.
    He had pushed the seat arm rest against the chair to hide the damage. Only when the driver sat in the chair and the arm fell on the floor was it clear he had broken the seat.
    It is impossible to claim it was broken before he took the car or he know nothing about contracts and law of damage.

    When you read these untrue stories from people trying to avoid paying for their cost liability, it no wonder David told the olive press SOME OF OUR CLIENTS ARE LIARS:

  12. My company rented a car for me in Spain continuously for 6 years, I needed to change the car every month and renew the contract. We used all the major companies depending on which one was cheapest at any given time. You could say I know a thing or two about renting in Spain.
    My conclusion: If you obey the rules, don’t tell lies, read the contracts, you will generally be fine.

  14. In reply to Ballard’s comment about my initial contract. The truth is that I signed an initial 3 month contract which expired on at the end of March 2012. ( I still have this paper work.) I paid in full to the end of March 2012. I never signed a twelve month contract.I never recieved another contact, so no contract existed. I simply told him I wanted to return the car a month later. He really is a complete liar as we all know. Having paid the March rental and been given a receipt for it, he had the nerve to ask for it again.His records reflect how bad the business is.

    Our socalled Policeman has not sued the car hire company after 6 months as he knows he will lose his case.
    No ,he has instead committed fraud by signing a declaration with his credit card company that he did not sign the slip, receive any service or have any dispute regarding the service and now he brags on the internet he has claimed his money back from his credit card company illegally-
    does this not show what type of person he really is. We are waiting for the court proceedings he has promised so that we can prove our case before a judge showing the contract Evans signed with no drivers chair broken.
    Tripadviser deleted all his posts after knowing he is not telling the truth and he posted from his friends who we have never traded with.

    Paranoid, Johnson has not issued legal proceedings in 2 years after he lost his case in arbitration with the Spanish reclamation office, WHY!!!! he too knows he has no chance to prove his case in front of a judge. We only wish he would so we can prove our case with all the photos invoices and emails.
    Stop calling me David Ballard, he will answer to you if he has time.You slander him and our company throughout the internet without any truth or legal recourse which is disgraceful.

    Rod Wigley is typical of the costs del sol conmen, he did not pay his hire contract on time and now posts a pack of statements which are totally untrue, and he too slanders the name of David Ballard without any legal recourse.

    Pity James Bryce did not check the facts before printing his story, we are happy to provide the signed contacts photos and costs to him or any person interested in the truth.

  17. I would just like to clarify a couple of points raised by Mr Richardson. Although I have claimed back the money wrongfully taken for my parents account, I provided to the credit card company all the documentation I was given at the time of hire from Mr David Ballard. So the Royal Bank of Scotland fraud unit made the claim on our behalf. Do you think they would have taken that action had I not been able to prove my case ? I think not Mr Richardson. You also forgot to mention you representative Monica who took the vehicle from me personally at Malaga airport and passed the vehicle all in order.From a legal point of view the aim was always to recover monies you took unlawfully. First part of that process was through the credit card company who issued payment, my next actions had that failed would have been to issue you and your company with legal proceedings. However as you well know you lost your case with RBS. And my parents got their money back eventually.In relation to your claims that you will send out documentation from your clients accounts via e-mail to anyone who wants to see it. Well that is a direct breach of the data protection act. And not an action to be recommended. The dealings I have had personally with your company have left a bitter taste. You appear to have more upset customers than any other car hire company in Malaga. Can they all be wrong Mr Richardson or just merely Liars as your partner put it. Anyway my advise would still be to avoid your company at all costs and as I stated to James Bruce in the original article, if this stops anyone else being treated as you have treated us then Iam happy with the outcome.     Thank you for your post, you have not clarified anything, but you have shown how unfamiliar you are regarding your contractual obligations,

    1. It is not your parents account or if it is you fraudulently presented the card on the contract you signed, you gave the credit card on the contract you signed on the strict legal basis it was your credit card account. You signed the contract and the credit card slip in your own capacity. If it is your parents account you would be required to notify us and they would be required to sign together with you

    2. You did not provide to the credit card company RBS all the documents, nor did you inform them there was a dispute, I spoke to the Royal Bank of Scotland regarding the card you provided to us, but they told me the chargeback was claimed on the basis of “not authorised payment” They were not aware the payment was in dispute or they would not claim back. We have sent your signed slip ,contract and damage invoices to RBS and they have promised to review your fraudulent claim back.
    The contract you signed gives us the authority to debit the card you gave us as your own on the contract, if there are costs relating to damage to the car.
    The contract you signed states if there is any dispute relating to charges on the contract the matter will be adjudicated by Spanish court or arbitration with AECA and will not be charged back to the credit card.You signed this contract and then ignored your legal liability under the terms of this contract.
    3…The royal Bank of Scotland are not an arbitration service and they were shocked when I told them you were claiming they had all the documents in this dispute and they were arbitrating the dispute on a rentacar contract according to you.
    4..Mr Evans you signed a contract, one of the conditions of the contract states the car will be inspected within 2 hours of return and damage notified to you within 24 hours.
    Do you honestly believe and ask all the internet to accept, a young girl sent to meet you in departures where the car has to be removed within 2 minutes can inspect a car and approve its condition when you took 35 minutes on receiving the car to inspect it and you did not specify on the contract the driver chair was broken.
    There is nothing legal in any of your points of view or your actions, only your greedy illegal intention to try avoid paying for the damage to the car you hired..
    5 Many people following the hundreds of posts you have put throughout the internet have called in our office to see the contract you signed showing no damage to the driver chair, they are very sad that a so called police officer can act in this fraudulent way and they all support us in our action against you.

    Mr Johnson our company has traded from 1988 and we have thousands of statisfied and regular clients thankfully which allows me to enjoy working for Briansrentacar.I have thousands of friends within the company and provide cars to them on a regular basis.
    Unfortunately like other car hire companies we meet clients who try avoid paying their cost laibility under the terms of hire and then spend hours posting their version of events on the internet as there is no cost to them and no legal recourse by the company they are attacking.
    I personelly dealt with your contract and the arbitration which you lost with the reclamation office and I truly wish you would take the matter to court where we could prove what a liar you really are to everybody.
    It is now 2 years and I know you will never take this action.
    I think Pauls sugestion on this link to provide the contract, photos and correspondence to anybody who really wants to see the truth is the best option.

  21. Hello everyone. Just shows that Briansrentacar are such a poor outfit, they dont even know who the contract was with ! The vehicle was booked by a family friend. I was the main driver. My father David Evans paid the hire cost on his RBS credit card. My father Signed the contract. I liaised with local authorities to recover what YOU unlawfully took from his account. Briansrentacar have claimed on tripadvisor that when The car was returned the arm of the seat was wrenched from the seat and on the cabin floor. Now they claim its in the upright position then fell off ! So what is the claim? Where is the evidence ? Mr Richardson can continue to rant on these websites fact still remains. You wont find a car hire company in Malaga with as many upset clients as he has. In my opinion its better to pay a little more and use a reputable company who don’t resort to sending pensioners threatening and abusive text and Emails in an attempt to bully and frighten them into paying money to repair vehicles he provides in already poor condition. Shame on you Mr Richardson. I would advise anyone who reads this who finds themselves in the same position to contact the Police Cybercrime unit in Malaga. They are also interested in this company.   22. Further to my previous comments I would just like to address the points made by Mr Richardson.
    Point 1, as stated above my father signed the contract, naming me on that contract as an additional Driver.I did not sign ANY Documentation, the card was in my fathers name.
    point 2,R.B.S WERE sent all the documentation you provided to me, including your contract,and yes it was contested as an unauthorised payment as your contract states sec 14 that in the event of a dispute we would both agree to attend the courts of Malaga,something you seem reluctant to do.
    Point 3,I have a recored delivery reciept for all the documents sent to R.B.S. and can produce that as well.
    Point 4,NONE of your 14 conditions on your contract say the vehicle will be inspected within 2 hours and notification sent within 24 hours.
    point 5,Showing documentation to third parties that contain private details is an Offence under the data protection act,As an established vehicle hire company you should know that.
    I had full authoristion from my parents to deal with this matter, that was put in writing to the R.B.S. and signed by my father.
    I have also recieved the above comments from Briansrentacar via E-mail, The sent it under the title LIAR. very proffesional .
    Anyway, pointless going around in circles with this matter .its clear for all to see what type of company Briansrentacar are, I just regret the day we ever booked with them,Better to use a more reputable company in my opinion.

    We have reported your conduct to the Manchester Police complaints department re your fraudulent conduct.
    RBS are reviewing your illegal chargeback and have not received all documents.
    We are still awaiting your court action in Malaga court and so far you have not commenced any legal proceedings in any court.
    Your friend living here in Spain has confirmed you broke the arm on the drivers chair which is the reason you spend your life posting your untrue version throughout the nternet and eventually we will get you in court to prove our case.
    Sorry story for a police man to ignore his contractual obligations.

    First you claimed the chair was not damaged, then you changed to we accepted the car at the airport so you are not liable, then you changed to the chair was damaged before you took the car.
    All these stories are not true and you know we can prove this in court.
    Your latest version is RBS credit card department gave you your money back with all the relevant documents.
    RBS claimed back on the basis of unauthorised payment which means you did not sign the slip.They did not have a copy of your signed authorisation slip nor did they have the contract and conditions all signed.
    We have sent these documents to them and they are reviewing your fraudulent chargeback.
    Finally you emailed from the Manchester Police department stating you were investigating our company which is also totally untrue according to Manchester Police complaints department.
    We have asked Olive Press to publish your contract showing only the car plan detailing existing damage at the time you drove away from the airport,
    This will show your true dishonest nature and end this fiasco once and for all.

    More upset customers of these companies coming forward highlighting exactly the same complaints as mentioned above.

  26. Upon reading the latest entries on trip advisor from a resident in spain, It would appear he has had the same problems with Briansrentacar/Alphacarhire, as others on this thread.
    According to that person Briansrentacar have had to move offices because of people attending and demanding money back!
    Finally looks like this Fiasco as Mr Ballard put it has finally come to an end !
    I hope so, but I would still advise people who are in dispute with these companies to contact the authorities.

Iam sure if he is still trading he will pop up on the forums with a different version of events. But that’s what we have all become used to.   31. Without being rude Mr Ballard, your statement is not correct, I am in contact with several other people who have had problems with your company.
    A common complaint by many is that you do not reply to e-mails and then refuse to answer phone calls from people who have disputes with you.
    With that in mind as a reputable company can you please answer the following
    1. Have you moved offices
    2. If so where are your new offices.
    3. What is the best way to contact you.
    I do agree with you that the Internet can be used to discredit companies, however where good service is offered it is a great way to attract new business.

  32. Well I see that the information I requested from Briansrentacar has not been posted. Says a lot about just how poor the company is.
    Mr Ballard and Mr Richardson if they are two different people continue to claim everyone else is at fault for problems they encounter with as they put it all the LIARS they rent cars to.
    Facts remain they never at any provided any evidence of their claim that we damaged the vehicle, either photos of estimates.
    The royal bank of Scotland claimed back what Briansrentacar unlawfully took from my parents account. The bank even compensated my parents on top of the charge back because of the poor service they had received.
    The company have told so many lies over the past months its no surprise to me they are struggling.
    My advise would always be avoid Briansrentacar AT ALL COSTS.

  33. Suppose it is boring to some Anna, not to the poor guy from london though who has not only been conned out of his deposit. He had been driven at in the aldi car park at Calahonda. So if you find it boring probably best not to comment. Unless of course you wish to provide details of the new address for Briansrentacar.

  35. I am just wondering if Anna is still finding this thread as she put it BOARING. Since that comment was posted THREE more complaints on tripadvisor. Are they LIARS too Mr Ballard ? I see you still have not posted your new buisness address !
    So I now invite you to do so if you are the reputable company you claim you are trading in Spain for over 20 years ?
    That will allow myself and others to correspond in writing and to officially register our complaints with yourself. Any reputable company would have no issues in doing that.
    I look forward to your new address being posted , but I won’t hold my breath !

  36. Well still no update from Mr Ballard informing of his new business address so that all his upset customers can put in writing their complaints.
    Not publishing his address also causes problems when the credit card companies need to contact. Seems the company prefer to just speak via their mobile phone. Gives them the option to just hang up when the questions get difficult.
    Just shows what contempt he holds for his customers.and how poor his business really is.
    Hopefully people will read the update in this publication and avoid this very poor company AT ALL COSTS.

  37. I know both David Evans, father and son and, I can personally vouch for their good characters, unlike Briansrentacar. I do not know a single person who has a good word to say about that company. I for one would never recommend them to anybody.

    Like Anne Payne who can vouch for con man Evans even though nobody has asked her to vouch for Briansrentacar and of course we do not know her so she will not know any of our thousands of happy clients.
    It’s quite pathetic and another Evans posting he should find something to fill his life

  40. Mr Ballard. Your so called thousands of happy customers appear to have deserted you don’t they ? All the posts on trip advisor are from different unhappy customers who have had the misfortune of renting from you to find you did the same to them, unlawfully retained their deposits.
    So do the decent thing POST YOUR BUISNESS address and allow people to contact you officially. Simple as that. But as usual you won’t , just use your mobile, shout and scream at anyone who has a dispute with you hang up. Provide no evidence and hope they will go away quietly.
    So David Ballard prove me wrong PRINT YOUR NEW BUISNESS ADDRESS.

    In reply to taking you to court in Spain. There is little point in chasing a one man band small company like yours that has little or no assets as the rewards would not meet the costs, a fact you are well aware of and use to your advantage.
    You never produce evidence of the damage you claim people cause to your sub standard hire vehicles, the reason for that is simple. There is no damage.
    If the situation is as you claim then add into your hire cost the extra damage waver insurance and claim from that. The problem would be then that the insurance companies would be onto you. That’s the truth of this matter, so you will continue doing what you do. Claim damage well after your vehicle has been returned customers safely out of the way, withhold deposit unlawfully.
    As long as customers researching car hire in Malaga and read these posts and avoid your company then every post will save another honest person from being conned out of their hard earned holiday money.
