A MAN who lost his arm in a buggy tour accident in Estepona has been awarded compensation after a seven-year legal battle.
A 36-year-old man, identified only as Raymond, who had his arm amputated after a crash on a guided buggy tour in Estepona has been awarded €300,000 in compensation.
The incident occurred in August 2019, when Raymond surprised his 15-year-old cousin with a guided buggy tour as reported by SUR.
Just minutes into the trip, his buggy overturned and his arm became trapped underneath.
Raymond, who was then 29 and working as a waiter in Benalmadena, claims the guide was driving too fast through a windy section of the road.
He claims he was struggling to see the route taken by the guide when the buggy overturned.
Raymond told SUR that an owner of a nearby property noticed the crash and called emergency services, while the guide did not notice the accident and returned around 40 minutes later, by which time an ambulance had already arrived.
Then, Raymond lost consciousness and later woke up in hospital, where he was informed that his arm had to be amputated.
After recovering from surgery and adapting to his new life, Raymond filed a lawsuit against the guided tour company in 2020.
From the outset, the company denied responsibility for the accident, arguing that because Raymond was driving the vehicle at the time of the crash, he was solely responsible.
The insurance company also took the same position
After a lengthy court process, the insurance company settled and agreed to pay €300,000 in compensation.
According to Raymond’s lawyer Joaquin Fernandez-Crehuetthe, the case was delayed for years due to difficulties in serving legal notices, despite the company being fully aware of the lawsuit.
